19 Jun ANDREW GIMIGLIANO SECURES A WIN BEFORE THE NEW JERSEY SUPREME COURT
Cedar Grove, New Jersey – June 19, 2019
June 19, 2019 – O’Toole Scrivo’s Andrew Gimigliano successfully won an appeal to the New Jersey Supreme Court. Andy obtained modification of an Appellate Division decision in a matter involving the firing of a public employee.
After a municipality fired a police officer for illegal drug use, the Office of Administrative Law recommended termination to the Civil Service Commission. The Appellate Division, however, reversed those determinations. The Appellate Division’s decision turned on the improper admission of hearsay evidence in the hearing before the Administrative Law Judge, but the panel did not remand the case for further proceedings in light of those errors. O’Toole Scrivo successfully petitioned the Supreme Court of New Jersey to review the case. After hearing oral argument, the Supreme Court modified the Appellate Division’s decision and ordered a remand, with a reminder that “justice is the polestar [of our judicial system]” and that cases should be decided on their merits, not procedural errors. The Supreme Court decision in In the Matter of Corey Corbo, Union City Police Department (081005) can be found here.
As a former New Jersey Supreme Court clerk, Andy has used his extensive appellate experience to lead O’Toole Scrivo’s highly successful Appellate Practice. In addition to his appellate practice, Andy routinely defends individuals and corporate clients in white-collar investigations and complex commercial matters.
