June 19, 2019 – O’Toole Scrivo LLC’s Andrew Gimigliano successfully won an appeal to the New Jersey Supreme Court. Andy obtained modification of an Appellate Division decision in a matter involving the firing of a public employee.
After a municipality fired a police officer for illegal drug use, the Office of Administrative Law recommended termination to the Civil Service Commission. The Appellate Division, however, reversed those determinations. The Appellate Division’s decision turned on the improper admission of hearsay evidence in the hearing before the Administrative Law Judge, but the panel did not remand the case for further proceedings in light of those errors. O’Toole Scrivo, LLC successfully petitioned the Supreme Court of New Jersey to review the case. After hearing oral argument, the Supreme Court modified the Appellate Division’s decision and ordered a remand, with a reminder that “justice is the polestar [of our judicial system]” and that cases should be decided on their merits, not procedural errors.
